Terms & Conditions
BOOKINGS, CANCELATION POLICY & PAYMENT
- All sessions are 50 minutes long, starting from the time of your scheduled booking.
- Sessions must be pre-booked & pre-paid to confirm your appointment.
- A 24-hour cancellation policy applies to all booked appointments. All bookings must be cancelled 24-hours prior to your class. A late cancellation or no show will result in a full fee being charged or one of your classes being deducted from your Pack or Auto Pay Pack. A failure to cancel within 24-hours or to attend a class will result in the class being forfeited and does not entitle the participant to a refund, credit or rescheduled class.
- Auto-Pay Packs are setup as auto payments. These payments are set up through Ezidebit and are renewed 24hrs before the series runs out.
- To cancel Auto-Pay Packs you must give written notice with a minimum of 1 session remaining.
- Prices are subjected to change without prior notice.
- Bookings are made via email, phone, SMS or directly with one of the studio staff members.
- In case of abrupt interruption of attendance caused by unforeseen circumstances, a refund can be issued with an admin fee of $50 will be applied.
- Duet sessions: Duet sessions: in case one of the participants is not able to attend the class, the class will automatically be converted into a Private session (Private rates will apply) unless the participant can find a replacement to join. Alternatively, the participant could join a semi-private class pending availability. Late cancellation policy applies for any cancellation with less than 24hrs notice.
- Owner and/or trainers reserve the right to restrict clients to a particular class type for safety reasons at their discretion. Owners and/or trainers reserve the right to turn clients away if they do not have the correct medical clearance.
- If a selected class is full, clients can request to be added to a wait list by phone, SMS or email. If a place in the selected class becomes available, participants will be notified by SMS, phone or email.
- The trainers teaching the class may change without prior notice.
- Trainers may teach up to four clients when determined by the studio that the quality of the service is not going to be compromised.
- Trainers and classes are subject to change without notice. Plank Pilates reserves the right to cancel classes if necessary.
CLIENT CODE OF CONDUCT
In the studio, you agree/ consent:
- To use all equipment with care and as instructed by the trainer
- To always follow the directions and instructions of the trainer for your own safety
- To not disrupt the class or threaten the environment in any way
- To be respectful and courteous to other people in the class, including the trainer.
- To allow the instructor to use the required physical contact (i.e., tactile cue), during the studio session to facilitate the best possible teaching methods
- Give permission for the studio to seek medical attention on my behalf, if necessary, in the case of an emergency or incident
- Give permission for images in which I appear to be used by Plank Pilates for publications on their social media accounts, website and/or marketing. Plank Pilates won’t publish any pictures without your verbal consent.
- That discrimination, bullying, sexual harassment, and victimisation directly or indirectly will not be tolerated nor accepted in any form towards any client and/or instructor/employee/contractor of Plank Pilates Studio.
- That Plank Pilates has the right to remove you from the class and not permit you to return to the studio (in which case you will be refunded your remaining credits) if in their opinion there is a breach of the client code of conduct or any of Plank Pilates’ T’s & C’s or policies.
ANIMAL POLICY
No animals are allowed inside the studio at any time. Plank Pilates has the right to ask you to leave if you have brought an animal in the studio.
PRIVACY POLICY
This privacy policy sets out how Plank Pilates ABN: 87718087642 and its related entities upholds your rights under the Australian Privacy Principles. This Privacy Policy for Plank Pilates notifies you of what personal information of yours we hold, what we do with it, who we will disclose it to and how you can assess the personal information we hold about you. Plank Pilates may change this Privacy Policy from time to time by updating this page.
WHAT INFORMATION WE COLLECT
Plank Pilates may collect the following information for your personal file, payment requirements, health and progress assessment, when referred for feedback to your health practitioner, contact details for next of kin in case of emergencies, demographic research, feedback reports:
- Name & Surname
- Contact information including email address and mobile.
- Date of birth
- Emergency contact person details
- Bank account and/or credit card details
- Payment history
- Demographic information such as postcode, preferences and interests
- Other information relevant to customer surveys and/or offers.
- Sensitive information such as injuries, ailments or illnesses that will influence your session, health or the safety of yourself and the instructor.
- An individual is not obliged to provide their personal information to Plank Pilates. However, without certain information it may not be possible for Plank Pilates to fully provide its services and/or products to the individual. Plank Pilates will never sell your information. All information is stored securely and treated with confidentiality.
INTELLECTUAL PROPERTY
- All Home Workouts, content, photographs, videos and any other materials on the Website, our Instagram page, Facebook page or remain the property of Plank Pilates.
- You must not reproduce, copy, share, sell, or deal with any of our Plank materials without our express written permission.
ONLINE CLASSES
Online Classes will be conducted by Plank Pilates at dates and times determined by Plank Pilates.
- The Participant participates in Plank Online Classes at their own risk. It is the Participant’s responsibility to create a safe and clear environment and agrees to only participate in Plank Online Classes if they are fit and able to do so.
- By participating in any Plank Online Classes, the Participant warrants and agrees that:
- They are not suffering from any injury, illness or condition that may prevent them from safely participating in Plank Online Classes.
- They understand the basic principles of Pilates and movements.
- They will comply with all directions and guidelines given by the instructor during the Plank Online Classes.
- They will immediately stop all physical activity and seek medical advice if they experience any faintness, shortness of breath, pain, or dizziness.
STUDIO AND ONLINE PILATES SESSIONS
- By viewing, accessing, using or participating in our Studio/Online Pilates Sessions, you agree to be bound by these terms and conditions and our Privacy Policy.
- As with any form of exercise, participation in Studio/Online Pilates Sessions, may involve certain risks to your health and safety. By participating in our Studio/Online Pilates Sessions, you warrant that you are not suffering from any injury, illness or condition that may prevent you from safely participating in our Studio/Online Workouts and or presential sessions.
- The Studio/Online Pilates Sessions, may be physically strenuous, and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death.
- By participating in our Studio/Online Pilates Sessions,, you warrant that you are at least 18 years old or have your parent/guardian’s permission and supervision to participate in the Studio/Online Pilates Sessions.
- By participating in our Studio/Online Pilates Sessions, you understand that you’ll be doing Pilates exercises using Pilates equipment and small apparatus and you are aware of the risk the Pilates equipment can offer, including risk of fall and breaking of the equipment.
- By participating in our Studio/Online Pilates sessions, you are aware that suffering an injury can result in loss of work, decrease of quality of life and death.
- Plank Pilates accepts no responsibility for any injuries or damage that may occur to the Participant and/or property during Studio/Online sessions.
LIABILITY WAIVER
By booking into a Plank Pilates class, you agree that:
- Plank Pilates is in no way responsible for the safekeeping of my personal belongings while I attend class.
- Plank Pilates does not assume responsibility for any lost or stolen personal property. If you do become the victim of a theft, immediately report it to a Plank Pilates staff member who will try and assist you.
- Classes may be physically strenuous, and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death.
- You, your heirs, assignees or legal representatives fully release Plank Pilates (and its associated entities, members, employees and contractors) from any claim, loss, damage or expense of any kind including in relation to personal injury, property damage/loss, or wrongful death, occurring at a Plank Pilates studio or elsewhere, whether caused by negligence or otherwise.
- Plank Pilates accepts no responsibility for any injuries or damage that may occur to the Participant and/or property during classes.
- The Participant agrees to indemnify and hold Plank Pilates harmless from all liabilities, claims, and expenses, including legal fees, that arise from the Participants use or misuse of the Website, Facebook Page or Instagram Page.
- Plank Pilates may, in our absolute discretion, change these terms and conditions from time to time without notice to you.
